Information requested

(a) The number of prosecutions and convictions relating to offences listed under s31(4) of the Immigration and Asylum Act 1999 and (b) the number of those cases in which the statutory defence mentioned in this Act was considered.

Response

(a) I enclose a copy of some of the information you requested relating to prosecution and convictions of the offences listed under s31(4) of the Immigration and Asylum Act 1999. The data provided in the attached table is a count of total offences prosecuted. People can be prosecuted for more than one offence.

(b) While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. Our criminal proceedings database does not contain information relating to defences presented in cases.

The Scottish Government Criminal Proceedings database is not a live system and the latest available information is for the financial year 2018-19. Information for 2019-20 will not be available until publication of the Criminal Proceedings in Scotland, 2019-20 Statistical Bulletin. This is expected to be published in the spring of 2021.
