Information request and response under the Freedom of Information (Scotland) Act 2002
Information requested
1. The average payment per month in a, Trust Deed, Sequestration & Debt Arrangement Scheme made by a debtor.
2. Total number of Trust Deeds, Sequestration and Debt Arrangement Scheme per Trustee/Company signed for the years:
(i) 1st January 2019 to 31 December 2019
(ii) 1st January 2020 to 31st December 2020.
3. Average debt level per Trust Deed, Sequestration and Debt Arrangement Scheme.
4. How many Trust Deeds & Sequestrations & DAS have been granted / awarded with a debt level between £5,000 and £8,000 since January 2020.
5. The number of Trust Deeds, Sequestration and DAS cases signed between 1st January 2019 and 31st December 2020 with a payment lower than £149 per month.
Response
1. The median approximate monthly payment for each of the statutory debt solutions are included in Table 1 (below), Information is based on the protected date for a Protected Trust Deed (PTD), the awarded date for bankruptcies, and the approved date for Debt Payment Programmes (DPPs) under the Debt Arrangement Scheme (DAS). Data is included for the calendar years 2019 and 2020.

1) Bankruptcy information is based on relevant Debtor Contribution Order. Protected trust deed information is based on latest (actual payment) Form 4 as at July 2020. Note only the total number of contribution ingathered and total realisation from contributions are available. It is not within AiB's remit to collect further information, including the frequency of contribution ingathered. Therefore, while care has been taken to ensure the PTD figure presented here is accurate as much as possible, caution is needed when interpreting this figure. Debt Arrangement Scheme information is based on eDEN administrative system for approved cases.
2) Figures rounded to nearest £10.
3) Figures are based on the original Debtor Contribution Orders, where contribution is set at more than £0. If zero contributions are included, then the median payment is £0. Variations are excluded from this table.
2. (i) 1st January 2019 to 31 December 2019
(ii) 1st January 2020 to 31st December 2020.
The total number of Trust Deeds protected, bankruptcies awarded and DPPs under the DAS approved by Trustee/Money adviser organisation for the calendar years 2019 and 2020 are included in Tables 2.1, 2.2 and 2.3 (below). Information is based on the protected date for a PTD, the awarded date for bankruptcies, and the approved date for DPPs under the DAS.
It should be noted that Minimal Asset Process (MAP) bankruptcies have been excluded from this table as The Accountant in Bankruptcy must act as the trustee in all MAP cases. There were 2,123 and 1,585 MAP bankruptcies in 2019 and 2020 respectively.

Information is based on the protected date for a PTD, the awarded date for bankruptcies, and the approved date for DPPs under the DAS.
Note that the 2020 figure for PTD is based on the completed Form 4 once each year until a PTD is concluded. The figure is lower than the 2019 figure because not all trust deeds protected in 2020 have completed the first year as yet. Therefore, caution is needed when interpreting this figure.
