Pay disputes with Crown Office Procurator Fiscal Service: FOI release

Information requested

1. Any correspondence (including emails, attachments, typed or handwritten notes, letters, notes/records of phone calls, minutes of meetings, briefings or otherwise) between the Crown Office Procurator Fiscal Service and the Scottish Government regarding pay disputes. Please limit to between 1 January 2020 and the present date.

2. Any correspondence (including emails, attachments, typed or handwritten notes, letters, notes/records of phone calls, minutes of meetings, briefings or otherwise) between the Crown Office Procurator Fiscal Service and the Cabinet Secretary for Justice regarding pay disputes. Please limit to between 1 January 2020 and the present date.

3. Any Scottish Government Cabinet meetings where the pay dispute at the Crown Office Procurator Fiscal Service was on the agenda. Please limit to between 1 January 2020 and the present date.

4. Meetings between the Crown Office Procurator Fiscal Service and the Scottish Government regarding pay disputes, with the dates and whether any Scottish Government Ministers attended these meetings. Please limit to between 1 January 2020 and the present date.

As the correspondence was originally received on 1 December 2020 this is the defined as the “present date” for the purposes of this request ie the period from 1 January 2020 to 1 December 2020.

Response

1. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections s.29(1)(a) (policy formulation); s.29(1)(b) (Ministerial communications); s.30(b)(i) (free and frank provision of advice); and s.38(1)(b) (personal information) of FOISA apply to that information. The reasons why these exemptions apply are explained in Annex A.
