You asked for

Number of reports of fly-tipping recorded in each year since a national system for recording such reports introduced,

number of reports recorded for those years for each local authority,

number of reports that have resulted in prosecution/legal action.

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have most of the information you have requested, in particular for the first and second bullet points of your request. The reasons why we don’t have the information are explained in the Annex to this letter and are summarized below: The Scottish Government is not responsible for the management or maintenance of the national system (FlyMapper) where local authorities can record flytipping incidents. The Flymapper system is managed by Zero Waste Scotland, who you may wish to contact at Ground Floor, Moray House, Forthside Way, Stirling, FK8 1QZ.
With regards to your third and final bullet point, I enclose a copy of some of the information you have requested relating to the ‘number of reports that have resulted in prosecution/legal action’. Enclosed is a breakdown of prosecutions for flytipping at a national level for the period 2014-15 to 2017-18.
Prosecutions for fly tipping offences under Section 33 of Environmental Protection Act 1990 are detailed below:

REASONS FOR NOT PROVIDING INFORMATION

The Scottish Government does not have the information

The Scottish Government is not responsible for the management or maintenance of the national system (FlyMapper) where local authorities can record flytipping incidents and as such does not hold the information you requested on either the number of reports at a national level or the number of reports for each local authority.
The Flymapper system is managed by Zero Waste Scotland and accessed by local authorities. There is no statutory requirement to use the national system, so information may not be gathered or available for all local authority areas. Zero Waste Scotland may be able to help you, and can be contacted via their website.
This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
