In relation to the document Supporting Transgender Young People - Guidance for Schools in Scotland, published and distributed by LGBT Youth Scotland and the Scottish Transgender Alliance, you asked for:

1. Copies of all documentation which clarifies the position of the Scottish Government in relation to this document, including endorsement or refusal to endorse.

2. Details of the terms under which any endorsement was given by the Scottish Government.

3. A list of all organisations and individuals who were consulted by the Scottish Government in the process of forming this position.

4. Copies of minutes or other record of all consultations by the Scottish Government with stakeholders including young people, parents, teachers, heads of schools, psychologists and other health professionals.

5. Evidence of all risk assessments or other assessments undertaken by the Scottish Government in the process of forming this position.

Response

1. I have attached a copy of a letter sent to Balfour and Mansons Solicitors, acting on behalf of the Christian Institute (Appendix 1).

2. The Scottish Government funded the development of LGBT Youth Scotland’s Supporting Transgender Young People in Schools guidance, which aims to help primary and secondary staff support transgender children and young people. While we welcome the publication of the guidance, it is up to individual schools and local authorities to decide what approaches to use, or which external partnerships to build, to help them deliver relevant and engaging learning. The Scottish Government does not endorse materials for schools and no endorsement of the guidance has been given. An error within the guidance stating that the Scottish Government has endorsed it has been corrected by LGBT Youth Scotland.

3. The Scottish Government was neither asked about nor considered endorsement, and we did not consult with organisations in this regard.

4. The Scottish Government was neither asked about nor considered endorsement, and we did not consult with organisations in this regard.

5. The Scottish Government was neither asked about not considered endorsement, and we did not undertake a risk or other assessment.
