Did South Lanarkshire Council or their Agents make application to the Secretary of State or Scottish Ministers for exemption from the minimum areas of a school site defined with the Schools Premises Regulations 1967 in respect of Biggar Primary School which has a design capacity of 316-450 pupils?
Have South Lanarkshire Council or their Agents made application since completion.
Has permission/exemption from the requirements of the School Premises Regulations 1967 been granted in respect of Biggar Primary School and if so when?
Response
South Lanarkshire Council or their agents have not, at any time, applied to Scottish Ministers for exemption from the minimum areas of a school site defined with the Schools Premises Regulations 1967 in respect of Biggar Primary School. Moreover, permission/exemption from the requirements of the School Premises Regulations 1967 has not been granted by Scottish Ministers in respect of Biggar Primary School.
However, in 2014, the Scottish Government contacted South Lanarkshire Council regarding matters relating to the size of Biggar Primary School. South Lanarkshire Council advised that it is satisfied that it did not contravene the School Premises (General Requirements and Standards) (Scotland) Regulations 1967.
