Information requested
This is a freedom of information request relating to Education Scotland (ES) Head of Digital Services between January 2015 until the present day. Please provide information by email in Excel format.
1. Please provide the names of any ES Head of Digital Services and the timeframe they were in that position.
2. Please provide a list of all contracts signed off by the Head of Digital Services and to who they were with. Please provide the dates for any suspensions, transfers or "firing" for this person during their time at ES.

Education Scotland has had a Head of Digital Services in place since July 2015. While our aim is to provide information whenever possible, in this instance we are unable to provide the name requested because an exemption under section 38(1) (b), personal information of FOISA applies to some of the information requested.
The reason why this exemption applies is explained below.

No contracts were signed by the Education Scotland, Head of Digital Services during their time at ES.
Please provide the dates for any suspensions, transfers or "firing" for this person during their time at ES.

Reasons for not providing information
Section 38(1)(b) - personal information
An exemption under section 38(1)(b) of FOISA (personal information) applies to some information requested because it is personal data of a third party, e.g. names/contact details of individuals and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998.
This is because releasing this information could lead to the identification of staff members.
This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
