Information requested

Under the Freedom of Information (Scotland) Act 2002, I would like to request the following information:

All correspondence regarding FOI/18/00444 within the Scottish Government. Information should include: correspondence (emails, typed or handwritten notes, letters, phone calls, minutes of meetings, briefs or otherwise) between staff, special advisers, civil servants who have responsibility for dealing with FOI requests, and any other relevant parties, where the topic of not releasing, withholding or redacting an FOI is discussed.'

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies to that information. The reasons why that exemption applies is explained below.

Reasons for not providing information

Additionally, some information has been redacted in some of the correspondence you have requested. The reasons for this are explained below.

An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, i.e. the names and contact details of individuals, and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Additionally, sections of correspondence and attachments below have been redacted because the information does not fall under your request, and are marked as "redacted- out of scope".
