Information on Scotland Transerv and how they are procuring their Street Lighting LED Lanterns.

Response

I have now completed my review of our response to your request under the Environmental Information (Scotland) Regulations 2004 (EIRs).

I have concluded that the original decision should be confirmed, with modifications.

I completed a full review of how your request was managed. Whilst some aspects of your request were correctly answered, I identified others which were not. I therefore attach a more comprehensive response to your original request, which I hope provides the necessary clarity. The attached document includes:

1. A background note;

2. A response to each of your eleven questions;

3. Output from our contract management system, which details LED expenditure undertaken in the South West Unit by Scotland Transerv on behalf of Transport Scotland;

4. Details of the recent Erskine Bridge Lighting and Electrical Works Contract, which included some LED installations.

In the original response to your request we applied an exemption under regulation 10(5)(e) of the EIRs (substantial prejudice to confidentiality of commercial information) to questions 1 and 2 however we were not entitled to apply this exemption as we do not hold that information. We should have refused your request under the exception at regulation 10(4)(a) of the EIRs because in this instance the Scottish Government does not have some of the information you have requested. I apologise that this was done.

In the original response to your request we applied an exemption under regulation 10(4)(b) of the EIRs to questions 5 and 7 to 11. I have concluded that we were not entitled to apply this exemption. Although we considered the questions to be the same as questions 1 and 3 we should have grouped those questions together for which the same answer could be provided. I apologise that this was not done.
