Fair Work First - conditionality in public sector grants: business and regulatory impact assessment
This business and regulatory impact assessment (BRIA) builds on the BRIA of the refreshed Fair Work action plan and anti-racist employment strategy (April 2023) which considered the impacts of Fair Work First (FWF) conditionality alongside the other actions in the action plan and strategy. This further BRIA looks at the impacts of FWF.
13. Implementation and Delivery Plan
Implementation of the rLW and effective voice conditionality commenced on 1 July 2023 and as such is being applied to public sector grants awarded on or after that date. The introduction of the conditionality to agriculture grants was delayed until the start of the following financial year.
As of 1 April 2024, the recipients of grants for the following agriculture-related funds are also required to meet this conditionality:
- Agriculture Environment Climate Scheme (AECS)
- Forestry Grant Scheme (FGS)
- Food Processing, Marketing and Co-operation Scheme (FPMC)
- Crofting Agricultural Grants Scheme (CAGS) and
- Sustainable Agriculture Capital Grant Scheme (SACGS).
This conditionality does not apply retrospectively to grants awarded before 1 July 2023 or 1 April 2024, respectively.
This BRIA is focused on issues arising during early phase of implementing the conditionality policy between 1 July 2023 and 31 March 2024. It therefore does not consider the aforementioned agriculture related grants as the conditionality did not apply to those until after the BRIA consultation was concluded.
