Recommendations and Conclusion
Actions based on EQIA findings
As the EQIA identified no negative impacts on any protected characteristic, no changes to the policy were required. However, the assessment highlighted the importance of clear guidance and inclusive practice. To support care homes with implementation of the policy:
- A statutory Code of Practice will be published to provide practical guidance for care providers and Essential Care Supporters, ensuring consistency and accessibility.
- The Code will include advice on flexibility in identifying Essential Care Supporters, including interpreters or cultural/religious liaisons where needed, to promote equality and inclusion.
- The code will be written in plain English and accessible formats will be provided to ensure older residents and those with communication needs can understand their rights.
Mitigation and promotion of equality
Although no adverse impacts were identified, these actions will promote equality by:
- Advancing equal access to family life for all residents, regardless of age, disability, or other protected characteristics.
- Supporting the PSED needs by fostering good relations between residents, families, and care staff, and encouraging inclusive decision-making.
Monitoring and review
The Care Reform (Scotland) Act 2025 requires a formal review of the policy after two years of operation.
