Scottish Infected Blood Amendment Scheme, effective from 1 April 2025. SIBSS is a scheme of support and assistance for those infected with Hepatitis C, HIV, or both, as a result of NHS treatment.
The Scottish Ministers make the following Scheme to amend the Scottish Infected Blood Support Scheme 2017 in exercise of the powers conferred by section 28 of the Smoking, Health and Social Care (Scotland) Act 2005 and all other powers enabling them to do so.
Commencement and interpretation
1. (1) This Scheme comes into force on 1 April 2025.
(2) In this Scheme, “the Principal Scheme” means the Scottish Infected Blood Support Scheme 2017 (as amended)(a)
Amendment of the Principal Scheme
2. The Principal Scheme is amended in accordance with paragraphs 3 to 11.
Uprating amendments
3. In Schedule 1-

Amendments relating to the Infected Blood Compensation Scheme
8. For paragraph 3(3) substitute -
(3) Subject to sub-paragraph (4), a person (“P”) who has accepted an offer for -
(a) a compensation payment of the core route amount in accordance with regulation 22(4) of the Infected Blood Compensation Scheme Regulations 2024), or
(b) an infected core payment or an affected core payment under the 2025 Regulations (whether or not P has also accepted an offer for another payment under the 2025 Regulations) where an election has been made in accordance with regulation 75(6) of those Regulations for the IBCS payment to be the non-support scheme amount, is not eligible to receive any payments under this Scheme.
(4) Payments may be made under Schedule 5 to persons to whom sub-paragraph (3) applies where an application for a payment under that Schedule was made and accepted prior to an offer for a payment mentioned in sub-paragraph (3)(a) or (b) being accepted by P.
(5) In this paragraph -
“the 2025 Regulations” means the Infected Blood Compensation Scheme Regulations 2025,
“affected core payment” has the meaning given by regulation 2(1) of the 2025 Regulations,
“core route amount" has the meaning given by regulation 22(3)(a)(i) of the Infected Blood Compensation Scheme Regulations 2024,
“IBCS payment” has the meaning given by regulation 2(1) of the 2025 Regulations,
“infected core payment” has the meaning given by regulation 2(1) of the 2025 Regulations,
“non-support scheme amount” has the meaning given by regulation 74(6)(b)(ii) of the 2025 Regulations.”.
9. In paragraph 18A(4) (recovery of overpayments), after “recoverable” insert “and may be assigned”.
10. After paragraph 19 (manager of scheme) insert -
Transfer to the Infected Blood Compensation Authority
20. Payments under this Scheme that are to be paid in respect of a period including 31 January 2026 and at least one subsequent day (whether or not the payment is also in respect of days prior to 31 January 2026) are to be made on a pro rata basis such that they are paid in respect of a period up to and including 31 January 2026 but not in respect of any subsequent period of time.
21. No payment is to be made under this Scheme in respect of any period from 1 February 2026 onwards, with the exception of payments under Schedule 5 where an application for the payment was made and accepted prior to 1 February 2026.”.

except where an application for a payment under this Schedule was made and accepted prior to an offer for a payment mentioned in sub-paragraph (a) or (b) being accepted.
4. In paragraph 3 -
“compensation payment” has the meaning given by regulation 2(1) of the Infected Blood Compensation Scheme Regulations 2024,
“IBCS payment” has the meaning given by regulation 2(1) of the Infected Blood Compensation Scheme Regulations 2025.”.
