Terms of reference for groups falling under Director General of Communities: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

The terms of reference for the "groups" falling under the Director General for Communities, including all (a) Directorates (b) Units and (c) Divisions under that Director.

For the avoidance of doubt this should include all groups that are active for which the Directorates/ Units/ Divisions are responsible, not just those listed at https://www.gov.scot/groups/.

For example, this would include -

  • Veterans Scotland Housing Group
  • The joint working group to oversee deliberative engagement on local government funding, including Council Tax
  • Temporary Accommodation Standards working group
  • Cladding Stakeholder Group
  • Homelessness Prevention and Strategy Group
  • Materials Shortage Working Group
  • RRTP sub-group of the Homelessness Prevention and Strategy Group

The release should include all versions of the terms of reference.

Should the request need to be narrowed, please narrow to the Directorate for Local Government and Housing.

I enclose a copy of some of the information you requested in the attached annex to this letter.

Some of the information you have requested is available from the Scottish Government website at www.gov.scot. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the websites listed, then please contact me again and I will send you a paper copy.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections s.17 (notice that information is not held) and s.38(1)(b) (personal information) of FOISA applies to that information.

An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, i.e. names, email addresses and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
