An exemption under section 38(1)(b) - Third Party Personal Data - of FOISA applies to some of the information listed above that you have requested. As such, the names of those who attended the meetings for which we are releasing information have been redacted. Please note that we have not, however, redacted any names that are already in the public domain or names of individuals of appropriate levels of seniority.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section s.38(1)(b) (personal information) of FOISA applies. An exemption under section 38(1)(b) of FOISA applies to the information requested because it is personal data of a third party, i.e. names of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
Scottish Government does not have a list of the meeting dates, or the minutes of meetings that you requested in respect of the Scottish Stoma Nurse Forum and the Scottish Stoma Care Nurse Group (SSCNG). I have provided you with the Scottish Stoma Forum minutes and agendas that we hold as detailed above. This is therefore a formal notice under section 17(1) of FOISA that the Scottish Government does not have all the information that you have requested.
