Response

1

This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested. While our aim is to provide information whenever possible, in this instance we are unable to provide the information you have requested because a remit was not provided to Professor Dennis to commission the “Progressive Stroke Pathway”.

2

This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested. While our aim is to provide information whenever possible, in this instance we are unable to provide the information you have requested because as there was no formal remit we cannot provide the information requested.

3

The “Progressive Stroke Pathway” was produced by the National Advisory Committee for Stroke to address the Programme for Government 2019/20 stroke commitment:

  • begin work to scope out and define what a progressive stroke unit looks like.

Further information can be found at: Supporting documents - Protecting Scotland's Future: the Government's Programme for Scotland 2019-2020 - gov.scot (www.gov.scot) Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website listed, then please contact me again and I will send you a paper copy.

4

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under FOISA applies. The details of why this exemption applies is explained below.

In this instance, an exemption under Section 38(1)(b) applies to some of the information requested because it is personal data of a third party, i.e. names and contact details, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Any documents (including emails) that may refer to restrictions imposed on the report before it was written and redactions required by the Scottish Government after if received the first draft of the report are also attached in FOI 202200325717 – Information Released – Annex and the separate file versions of the progressive Stroke Pathway:
