Stop and Search Code of Practice

The Cabinet Secretary noted Police Scotland’s intention to publish interim operational search guidance for officers.

The Chief Constable confirmed that guidance would issue this afternoon (25 June), with changes focused on addressing issues raised by the Supreme Court judgement on sex and gender. The Chief Constable confirmed that detailed legal advice had been taken to support the decision, and considers its position consistent and in line with forces across the rest of the UK.

The Cabinet Secretary indicated the Scottish Government’s intention to launch a consultation on revising the existing code of practice by the end of July, in line with our statutory obligations. There was an exploration of whether there were options to more closely align the timing of the guidance and the launch of the consultation. The Chief Constable noted the need for clarity for officers and staff which meant there was a need to proceed now with the guidance. She added that this matter would be discussed at the SPA Board meeting on Thursday 26 June.

Police Pay Negotiations

The Deputy Chief Constable confirmed PNBS met last week and that weekly engagement with staff associations and unions on pay continues.

Don McGillivray confirmed that consideration is being given to next steps in negotiations in terms of the Government’s position and that further engagement is expected later that week.

PECCS Act

The Chief Constable acknowledged positive momentum in supporting implementation, with a focus on the Code of Ethics and Duty of Candour, alongside progress on vetting and conduct regulations.

The Deputy Chief Constable explained that the next probationer intake on the 7 July would take a slightly amended oath, to reflect the recent changes. This could attract some media attention which would be welcome.

Youth Violence

The Cabinet Secretary acknowledged the work underway and the contribution of Police Scotland to recent government events. She indicated that the Government’s focus would remain on prevention.

The Chief Constable reported strong momentum and positive work in prevention underway.  She referred to positive initiatives like the campus policing model as well as VRU initiatives and the Crimestoppers Fearless Campaign. She noted that Police Scotland would continue to provide a measured perspective on trends, based on data.

Trauma Support

The Cabinet Secretary passed on concerns that had been raised with her by the Scottish Police Federation regarding aspects of Police Scotland’s trauma support provision. PS noted that they have written responding to similar concerns raised with them and would be engaging further with SPF on this issue.
