Ness District Salmon Fishery Board rejected application: EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004.


Information requested

Please accept this email as a response to the determination outlined in the letter received from MSLOT on the 7th June (MF01-Ness-Final seal response letter).

We would like to appeal the decision outlined in the letter mentioned above, but cannot do so within the stated two week appeals period, without full knowledge of the advice received by MS-LOT in making their determination. I would be grateful if you could forward copies of all advice received pertaining to the application by the Ness District Salmon Fishery Board, including, but not limited to, advice from NatureScot and Marine Scotland Science.

We do not agree “that further assessment of non-lethal measures such as ADDs need to be assessed for efficacy”. The Ness application detailed examples of exhaustive trials with ADDs on the River Ness, all highly ineffective. We request sight of the evidence given by respondents on this issue, in particular.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exception under Regulation 11(2) (personal information of a third party) of the EIRs applies to that information. The reason why that exception applies is explained in the Annex to this letter.
