A scheme of fixed penalty notices for the fishing industry was introduced in April 2008, and extended to include other marine and aquatic offences in 2013.

Fixed penalty notices do not replace existing criminal sanctions but provide an additional enforcement option.

If anyone is unhappy at being given a fixed penalty notice they will have the option to refuse it and have the case referred to the Crown Office and Procurator Fiscal Service (COPFS) for consideration of criminal proceedings.

A guidance document is available to download below which contains full details of the fixed penalty notice scheme.
