Israeli Deputy Ambassador meeting: FOI disclosure

Statement setting out that we will not appeal the Scottish Information Commissioner's decision requiring disclosure of information relating to a meeting with Israel's Deputy Ambassador.


On 29 April 2026, the Scottish Information Commissioner issued a decision notice (087/2026) requiring us to disclose previously withheld information relating to a meeting between the former Cabinet Secretary for the Constitution, External Affairs and Culture and Israel’s Deputy Ambassador to the UK, which took place on 8 August 2024.

We withheld some of the information requested, arguing that disclosure would, or would be likely to, prejudice substantially relations between the UK and the state of Israel or the effective conduct of public affairs. The Commissioner disagreed and ordered the information to be disclosed.

We have carefully considered whether to appeal the Decision of the Scottish Information Commissioner. On this occasion it was decided not to appeal, despite considering there were reasonable grounds, taking into account the position of the Commissioner and the risks and costs of litigation. We remain concerned that the Decision risks inhibiting open diplomatic dialogue.

Our publication of the material in this case does not set any precedent for our position on releasing other information that is subject to exemptions under section 32(1)(a)(i) or section 30(c) of the Freedom of Information (Scotland) Act. We agree  with the Commissioner that exemptions must be applied on a case-by-case basis. We will continue to apply the relevant exemptions in line with the Freedom of Information (Scotland) Act 2002.
