I enclose a copy of some of the information you requested. I have attached the case sheets and interim inspection report for 2021-0588. These are yet to be publicly available online, however, they are in the final stages of completion, and we do not believe they will be subject to significant change. There is an outstanding sample result, and subject to outcome, a further report may be issued, which will be published in full as part of the FHI proactive publication plan. For the remaining case numbers, I have applied an exception under regulation 10(4)(d) of the EIRs, which applies to some of the information you have requested. Exception 10(4)(d) has been applied because the material is in the course of completion. The field case notes are still being completed because we are waiting for further discussions and information from third parties, therefore, the inspection reports are yet to be drafted.
This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. We recognise that there is some public interest in release because of the interest in health status of fish farms in Loch Etive and activity of the Fish Health Inspectorate. However, this is outweighed by the public interest because the information is likely to change and, therefore, at this stage may not provide an accurate and true account of the inspection, findings and, should they occur, recommendations.
For the following cases, 2021-0391, 2021-0392, 2021-0393 and 2021-0394, we expect the inspection reports to be finalised within 12 weeks. The case information and reports from the FHI are published on https://www.gov.scot/collections/publication-of-fish-health-inspectorate-information/ and should be available here by 19 August 2022.
