Information on actions for division and sale and recalls: FOI release

Information requested

1. the number of successful division and sale actions carried out by AiB;
2. the average cost of an action
3. average case load;
4. average time for recall cases, the shortest and the longest time;

in the last five years.

Response

I enclose some of the information you requested on Annex A to this letter:

1. the information provided is the number of actions concluded in each year.
2. the average cost of an action shown is only for the legal costs, It does not include any associated costs such as chartered surveyor or sheriff officers. While it is our aim to provide information where possible in this instance the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600.00. The reason for this is that we would require to examine each individual case to establish all costs. Under section 12 of FOISA public authorities are not required to comply with a request if the authority estimates the cost of complying would exceed the upper cost limit. which is currently set at £600 by Regulations made under section 12 of FOISA. You may, however, wish to consider reducing the scope of your request in order that the request can be brought under £600. For example, you could reduce the period of your request.
3. the figures provided are the opening balances of our caseload for each year. These figures do not include non trace cases.
4. this information relating to recalls has been provided in full.
