Information requested

Any documents, meetings, communications and discussions within and between the Scottish Government, SCTS and Judiciary of Scotland and Lord President, and with any other public authority in relation to the retirement of, and any Police Scotland and Crown Office investigation, and any criminal charges relating to Former Sheriff Alistair Duff, and any dates when the Scottish Government became aware or were made aware (by who or which organisation) of any investigation by Police Scotland and the Crown Office of now former Sheriff Alistair Duff.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions of FOSIA apply to tha  information.

Exemptions
An exemption under section 37 of FOISA applies to some of the information you have requested. This exemption applies to court records.

An exemption under section 38 of FOISA applies to some of the information you have requested. This exemption applies to personal information including names, job titles and contact details.

Exemptions under section 37 and section 38 of FOISA are not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
