Lord Bracadale carried out an independent review which recommended that the Scottish Hate Crime legislation should be consolidated into a single piece of legislation and that some additional changes should be made to the current legislation.

The Hate Crime Bill will consolidate all existing Scottish Hate Crime legislation and we propose adding a couple of new “aggravations” (existing offences can be aggravated by prejudice in respect of one or more of the protected characteristics of race, religion, disability, sexual orientation and transgender identity) for age and gender .

We also expect that following the consultation there may be calls to add “vulnerability” and to define sectarianism as a separate aggravation.

Our consultation and Hate Crime Bill will be based on Lord Bracadale’s independent review of hate crime.

We will base our legislative changes on the review and our forthcoming consultation.

This legislation will be brought forward to make societal change in that it will make administrative changes relating to legal definitions and add new “aggravators” to improve and make more transparent the sentencing relating to hate crime. .

The legislation will have no or minimal impact on the environment and on the health of the population.
