Electricity Act 1989 - sections 36 and 37: applications guidance
This good practice guidance sets out the procedure for applications for onshore generating stations and overhead lines under sections 36 and 37 of the Electricity Act 1989, where the development concerned is development requiring environmental impact assessment.
Updates
An update was published on 04 July 2022 as a result of changes to paragraphs 5.2.2 and 5.2.3, and the replacement of the link at paragraph 5.2.4 to refer to updated Necessary Wayleaves Guidance published in March 2022.
An update was published on 01 October 2025 as a result of changes on PDF page 15 to sections 6.3.1 and 6.3.2. The HTML and PDF have been updated to reflect these changes.
An errata was published on 20 January 2025 following an amendment to the content on PDF page 16, specifically 6.3.2. Both the HTML and PDF versions have been updated to reflect these changes.
