Information request and response under the Environmental Information (Scotland) Regulations 2024
Information requested
Could you supply all documentation held, including correspondence sent and received (including internal), minutes/notes from meetings, briefings and analysis, about John Swinney's trip to Tomatin to Moy on February 10, from between January 15 2026 and March 15 2026?
Response
Please refer to attached Annex A containing correspondence from the requested date range regarding the First Minister’s visit to the A9 Dualling: Tomatin and Moy, along with Annex B which includes an engagement briefing issued to the First Minister ahead of his visit.
An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information you have requested because it is the personal data of a third party. While our aim is to provide information whenever possible, in this instance a small amount of information, i.e. names of junior Scottish Government officials and employees of other organisations, have been redacted.
This exception applies because disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and section 34(1) of the Data Protection Act 2018.
This exception is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
