Information request and response under the Environmental Information (Scotland) Regulations 2004

Information requested

Provide us with the following information in relation to the A8 Dual Carrigeway between the Woodhall Roundabout and Langbank:

Confirmation of the relevant road’s authority responsible for the maintenance and inspection of the road as at and 04/11/2025.
Maintenance records including records of independent contractors working in relevant area between the dates 04/11/2024 and 04/11/2025.
Records of complaints about surface water affecting the road between the dates 04/11/2022 and 04/11/2025.
Records of inspection of the road between the dates 04/11/2024 and 04/11/2025.
Records of accidents which have occurred on the road between the dates 04/11/2022 and 04/11/2025.
Records of remedial works to address surface water affecting the road on or after 04/11/2025.
Details of the adverse weather and flood warning policy in place between as at 04/11/2024 and any changes to said policy after that date.

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

Q1. You asked for confirmation of the relevant road’s authority responsible for the maintenance and inspection of the road as at and 04/11/2025.

A1. Transport Scotland's Operating Company, Amey, were responsible for the maintenance and inspection of the road on 04/11/2025.

Q2. You requested maintenance records including records of independent contractors working in relevant area between the dates 04/11/2024 and 04/11/2025.

A2. Please see Annex A to this response for defect details for the period above.

While our aim is to provide information whenever possible, in this instance Transport Scotland does not some the information you have requested. Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs. This is because there is no records of contractors working at this location on the requested dates.

This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information about independent contractors working in the relevant area between the dates 04/11/2024 and 04/11/2025, clearly we cannot provide information which we do not hold.

Q3. You requested records of complaints about surface water affecting the road between the dates 04/11/2022 and 04/11/2025.

A3. Surface water complaints are logged as incidents and reacted to by Amey's Incident Support Units. Please see Annex B to this response for details of flooding incidents for the period 04/11/22 to 04/11/25.

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.

Q4. You requested the records of inspection of the road between the dates 04/11/2024 and 04/11/2025.

A4. Please see Annex C to this response for inspection records.

Q5. You requested records of accidents which have occurred on the road between the dates 04/11/2022 and 04/11/2025.

A5. While our aim is to provide information whenever possible, in this instance Transport Scotland does not some the information you have requested. Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs. This is because records held by Transport Scotland relate only to collisions involving injuries or fatalities that have been reported to, and are known by, Police Scotland. As such, we do not hold records of collisions that resulted in damage only.

Please see Annex D to this response for details of the total number of accidents on the A8 Dual Carrigeway between the Woodhall Roundabout and Langbank (not including the roundabouts), broken into a table reflecting each year from 4 November 2022 to 4 November 2025.

This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in records of all accidents which have occurred on the road between the dates 04/11/2022 and 04/11/2025, clearly we cannot provide information which we do not hold.

Q6. You requested records of remedial works to address surface water affecting the road on or after 04/11/2025.

A6. Amey advise there are no records available of remedial works to address surface water affecting the road on or after 04/11/2025.

Q7. You requested details of the adverse weather and flood warning policy in place between as at 04/11/2024 and any changes to said policy after that date.

A7. While our aim is to provide information whenever possible, in this instance Transport Scotland does not some the information you have requested. Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs. This is because there is no flooding management plan for this specific area as it is not high risk or identified as requiring its own plan.

This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information regarding any adverse weather and flood warning policy, clearly we cannot provide information which we do not hold.

The area specified in this request is covered by Amey's pre-deployment plan, where if the precipitation amount reaches a certain threshold over a 24-hour period, flood patrols would be deployed to cover the area.
