Information requested
You asked for what guidance, advice or other information we have given to the Scottish Children Reporter's Administration (SCRA) to ensure that the organisation is compliant with the Equality Act 2010.
Response
I enclose a copy of most of the information you requested.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section s.38(1)(b) (personalinformation) of FOISA applies to that information. Section 38(1)(b) of FOISA means that information can be withheld if releasing it would involve sharing someone’s personal data in a way that would breach data protection laws under the UK General Data Protection Regulation (GDPR).
This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
For clarity, the contents of the documents attached will be explained below.
Document 1 is an email to a staff member at SCRA referencing a note published for Public Bodies regarding the UK Supreme Court ruling on the meaning of sex in the Equality Act 2010 on the Scottish Government's website in June 2025. Document 2 is an email to Chief Executives of Public Bodies with a link to the note published in June 2025.
Document 3 is an email to Scottish Government Sponsorship Teams referencing an update that was issued to Chief Executives of Public Bodies in September 2025. This update is found in Document 4.
