Current status of Section 8 of the Transport (Scotland) Act 2019 in regards to Keeper Liabilities: FOI release

To confirm the current status of Section 8 of the Transport (Scotland) Act 2019 in regards specifically to Keeper Liabilities and whether it, at present, has been commenced or not and whether there are any timescales in force that might suggest if/when it may come into force.

I can confirm that Section 8 of the Transport (Scotland) Act 2019 has not yet been brought into force. To do so will require further secondary legislation. To provide some background, the Department for Transport (DfT) recently undertook a consultation, which closed in late 2025, on changes to a Private Parking Code of Practice. This document sets out best practice for the private parking industry. The findings of this consultation, and any subsequent amendments to the Code of Practice, will be critical in shaping our own consultation and informing the development of the secondary legislation. We currently do not have a set timescale for the secondary legislation to be brought into force but we are in close contact with colleagues in DfT regarding the Code of Practice.
