Transport Scotland - cost of artwork for Tomatin to Moy Project: EIR release

Information requested

We wish to be provided with the costs that will be incurred/allocated to the creating of artwork designs, production and its installation on the Tomatin to Moy Dualling section.

This can be the budget figure allocated for this work.

Response

While our aim is to provide information whenever possible, in this instance Transport Scotland does not have all of the information you have requested. The costs associated with the design, production and installation of the artwork referred to is included within the £185 million contract awarded to Balfour Beatty in July 2024, and as such, cannot be disaggregated within the information we hold. Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have.

This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. While we recognise there may be some public interest in spend related to the A9 Dualling: Tomatin to Moy project, we cannot provide information which we do not hold.

I can confirm that it is proposed that artwork is created and will be located at the Tomatin Grade Separated Junction as well as at two enhanced lay-bys on the A9 (Allt na Slanaich northbound layby and Aultnaslanach Viaduct southbound layby). A local artist has been employed to develop the artwork, reflecting the history of the local landscape and taking on board feedback from the local community.
