Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
Response to your request
I will retain your numbering for ease.
Please note that the records held by Transport Scotland relate only to collisions involving injuries or fatalities that have been reported to, and are known by, Police Scotland. As such, we do not hold records of collisions that resulted in damage only.
The information provided in response to Q1 and Q2 below should be read in conjunction with the notes attached in Annex A.
Q1. You requested the number of road traffic collisions that have occurred one mile before (southbound) the Queensferry Crossing, on the Queensferry Crossing (southbound), one mile after (southbound) Queensferry Crossing;
A1. There were 10 personal injury road traffic collisions southbound that occurred 1 mile before, including or 1 mile after the Queensferry crossing.
Q2. You requested the number of road traffic collisions that have occurred one mile before (northbound) the Queensferry Crossing, on the Queensferry Crossing (northbound), one mile after (northbound) Queensferry Crossing.
A2. There were 6 personal injury road traffic collisions northbound that occurred 1 mile before, including or 1 mile after the Queensferry crossing.
Q3. You requested the number of non-injury road traffic collisions each year.
While our aim is to provide information whenever possible, in this instance Transport Scotland does not have the information you have requested. Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs. Transport Scotland does not have this information because data relating to non-injury traffic collisions is not routinely recorded. You may wish to contact Police Scotland to enquire if they hold any non-injury traffic collision data. You can contact them via the following link Home - Police Scotland
This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information about the number of non-injury road traffic collisions on the QFC for each year stated above, clearly we cannot provide information which we do not hold.
Q4. You requested the number of minor injury road traffic collisions each year.
A4. Please see Table 1 in Annex A to this response for details of minor injury road traffic collisions each year as stated above.
Q5. You requested the number of serious injury road traffic collisions each year.
A5. Please see Table 1 in Annex A to this response for details of serious injury road traffic collisions each year as stated above.
Q6. You requested the number of fatal road traffic collisions each year.
A6. Please see Table 1 in Annex A to this response for details of fatal road traffic collisions each year as stated above.
