Information requested
All emails, letters, texts, messages sent via written or digital communication methods (including encrypted apps), meeting agendas, briefings and minutes involving the following people:
- Siobhian Brown Minister for Victims and Community Safety
- Members of the Scottish Fire and Rescue Service Strategic Leadership Team
- Members of the Scottish Fire and Rescue Service board.
the information requested relates to when timing of when results/decisions/outcomes of the Scottish Fire and Rescue Service's Service Delivery Review will be made public.
Response
I enclose a copy of the information you requested. This takes the form of five separate documents.
An exemption under section 38 1(b) Third Party Personal Information of FOISA applies to some of the information you have requested. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
An exemption under 30(b) Substantial Inhibition to free and frank advice applies to some of the information you have requested. This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is a public interest in disclosing information as part of open, transparent and accountable government. However, there is a greater public interest in protecting the space for the effective sponsorship of a major public body, such as the SFRS, as well as the development of government policies and, ultimately, the effective conduct of public affairs.
