- In the last five financial years including 2025-26, how many incidents have taken place on the A96?
- How many of these incidents have been (I) Fatal (II) Serious (iii) Slight

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
Q. In the last five financial years including 2025-26, how many incidents have taken place on the A96?
A. The records we hold relate to personal injury collisions where someone is injured or killed, and which become known to Police Scotland. We do not hold records relating to damage-only collisions. In the last five financial years, from 01 April 2021 to 05 October 2025, there have been 133 personal injury collisions recorded on the A96 between Raigmore Interchange to Craibstone roundabout (not including either roundabout).
Please note that the above information is based on monthly returns received thus far from Police Scotland. This presents an incomplete picture of collisions for recent months due to a slight lag between collisions occurring and records being processed and shared by Police Scotland.

A. Of these collisions, 13 were fatal, 67 were serious and 53 were slight.
Q. How much money has been spent on upgrading parts of the A96 that are located in Moray in the last five financial years including 2025-26?
A. Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have. Transport Scotland does not have the information you have requested because we do not hold figures broken down to this level. However, we can provide the total spend per route figures and these are provided in the table below.
This exception is subject to the 'public interest test'. While we recognise that there may be some public interest in information about how much money has been spent on upgrading parts of the A96 that are located in Moray in the last five financial years including 2025-26, clearly we cannot provide information which we do not hold.
