Chief Medical Officer and Chief Statistician appointment and resignation letters: FOI release

Information requested

I am responding to your request for "the appointment letters of the Current CMO Current CS Of Scottish Government, and any resignation letters from anyone else who has held the posts. CMO on this request is Chief Medical Officer Scottish Government CS on this request is Chief Statistician Scottish Government."

Response

I enclose a copy of some of the information you requested. Attached are a copy of the current CMO and Chief Statisticians appointment letters along with a resignation email from Aileen Keel (a previous CMO).

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some the information you have requested. The reasons why we don't have the information e.g. resignation letters are that in some cases previous post holders were appointed on secondment and therefore have a natural end date.

An exemption under section s381(b) of FOISA applies to some the information you have requested. This exemption, applies to some of the information requested because it is personal data of a third party, i.e. names of junior members of staff and contact details. Disclosing this information would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption on the Scottish Governments delegated grades,
