Disclosure Scotland transgender & non-binary applicants page: FOI release

Information requested

Please provide a copy of the risk assessment carried out by you (and any related information) for the statement made on your website dated 1st April 2025 which is headed, 'Information for transgender & non-binary disclosure applicants'.

Response

Disclosure Scotland does not have the information you have asked for because we did not carry out a risk-assessment on the 1 April update to our ‘Information for transgender & non-binary applicants’ page. This update was made because of the changes brought by the Disclosure (Scotland) Act 2020, which went live on 1 April.

The transgender applications page was amended on that date solely to update the application types to those brought in under the Disclosure Act. Disclosure Scotland has used the same process for transgender applications since 2002.

This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
