Scottish Ministers meeting with the Equality and Human Rights Commission (EHRC) details: FOI Review

On the 10th on June 2025, Scottish Ministers met with the EHRC. Please provide the minutes from that meeting - including the names of those in attendance and the length of the meeting.

Response

I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for:

“It is now beyond reason that these minutes would not have been signed off some 14 weeks after the meeting occurred. I believe these minutes are being deliberately held back. Please provide me with a copy of the minutes from the meeting requested or advise why this cannot be done so that I may refer this to the Scottish Information Commissioner."

I have concluded that a different decision should be substituted and that the minutes requested can now be released to you subject to some redactions. I apologise that at request stage we indicated that they were not held, this was incorrect. In reconsidering the requested information I have determined that they can be released now, please see attached.

An exemption under section 38(1)(b) of FOISA (personal information) applies to a small amount of the information requested because it is personal data of a third party, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Furthermore, I note that you ask for the length of the meeting, this is something that we do not record and therefore we do not hold. This is a formal notice under 17(1) of FOISA that we do not hold the information you have requested.
