Non-harassment order data: FOI release

Information requested

The total number of non-harassment orders issued under the Criminal Procedure (Scotland) Act 1995 and Protection from Harassment Act 1997 between 1997 and 2025, with distinction being made between orders issued by the civil and criminal courts.

The number of people prosecuted in Scottish courts for breaches of non-harassment orders from 1997 to 2024-25 with distinction being made between orders issued by the civil and criminal courts.

I enclose a copy of some of the information you requested attached:

• The total number of non-harassment orders issued under the Criminal Procedure (Scotland) Act 1995 and Protection from Harassment Act 1997 between 2017-18 and 2024-25: orders issued in criminal courts.
• Breaches of non-harassment order prosecuted in Scottish courts, 1997-98 to 2022-23.

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. The reasons why we don't have the information are explained below.

The Scottish Government Criminal disposals dashboard does not have data on NHOs issued prior to April 2017. The Criminal disposals dashboard also does not have data on NHOs issued by civil courts. However, you may wish to contact the Scottish Courts and Tribunals service at enquiries@scotcourts.gov.uk who may be able to help you. The Scottish Government criminal proceedings database does not have data on prosecutions after March 2023.
