Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
Any internal or external correspondence, including any attachments, WhatsApp messages, text messages, instant messaging, memos, OneNotes, minutes, agendas, appendixes or other correspondence, relating to the band Oasis and their upcoming concerts in Edinburgh.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section(s) of FOISA applies to that information.
- 30(c) - Prejudice to effective conduct of public affairs
- 38(1)(b) - Personal data relating to third party
- 39(1) - refuse to disclose information if disclosure would, or would be likely to, endanger an individual’s: (i) physical health; (ii) mental health; (iii) safety
The reasons why the exemptions apply are explained below:-
- Section 30(c) – Prejudice to effective conduct of public affairs
Some information has been withheld as an exemption under section 30(c) (prejudice to effective conduct of public affairs) of FOISA applies to that information.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is a public interest in disclosing information as part of open, transparent and accountable government, and to inform public debate. However, there is a greater public interest in protecting the process of how some operational and security decisions have been made, disclosure of this information is likely to undermine the Agency’s ability to perform its function of safe operation of the public transport network and the public events which would not be in the public interest.
- Redacted under section 38(1)(b) – Personal data relating to third party
Some information has been withheld under Section 38(1)(b) of the Freedom of Information Act 2000.
This exemption applies where disclosure would, or would be likely to, endanger the safety of any individual. In this case, the redacted material contains details that, if disclosed, could pose a risk to the safety of third parties involved in the event. This includes individuals whose roles or identities are not publicly known and whose exposure could lead to unwanted attention or harm. We have carefully considered the public interest in transparency and accountability. However, we have concluded that the public interest in maintaining the safety of individuals outweighs the public interest in disclosure. Therefore, this information has been withheld in accordance with Section 38(1)(b).
- Redacted under Section 39(1) - refuse to disclose information if disclosure would, or would be likely to, endanger an individual’s: (i) physical health; (ii) mental health; (iii) safety
Some information has been withheld under Section 39(1) of the Freedom of Information Act 2000. This exemption allows public authorities to refuse to disclose information if disclosure would, or would be likely to, endanger an individual’s:
- (i) physical health
- (ii) mental health
- (iii) safety
The exemption applies where there is a real and significant likelihood that disclosure would endanger health or safety. We have considered the public interest in transparency and accountability. However, in this case, we have concluded that the public interest in protecting individuals and ensuring the safe delivery of the event outweighs the public interest in disclosure.
