Information request and response under the Environmental Information (Scotland) Regulations 2004
Information requested
I am submitting this request under the Freedom of Information (Scotland) Act 2002. I would like to request the following information: All internal and external communications (including but not limited to emails, meeting minutes, letters, reports, and file notes) between Scottish Forestry, FSFC Company 1 Ltd, and Vattenfall Wind Power Ltd, that relate to:
1. Compensatory planting obligations linked to wind energy developments on Scottish Forestrymanaged land in Clashindarroch Wind Farm;
2. Any discussions of land-use planning at Carlinden Burn in the context of fulfilling such obligations;
3. Any documents referencing Carlinden Burn as a potential or confirmed compensatory planting site for wind turbine development.
Please include:
- Any communications involving Scottish Forestry Conservancy staff, project officers, or other Scottish Forestry representatives;
- Any references to Forest Plans, FGS applications, legal or financial obligations, or carbon offsetting associated with the compensatory planting.
Response
I have attached all the information we hold regarding your request.
While our aim is to provide information whenever possible, we are unable to do so in this instance for some of the requested information because of an exception under regulation 11(2) of the EIRs (personal information of a third party), resulting in that information being redacted.

REASONS FOR NOT PROVIDING INFORMATION
Personal data relating to a third party
An exception under regulation 11(2) of the EIRs (personal information) applies to some of the requested information because it is personal data of a third party and disclosing it would breach the data protection principles in Article 5(1) of the General Data Protection Regulation and section 34(1) of the Data Protection Act 2018. This exception is not subject to the ‘public interest test’, so we are not required to consider whether the public interest in disclosing the information outweighs the public interest in applying the exception.
