Information request and response under the Environmental Information (Scotland) Regulations 2004
Information requested
I am writing to request information under the FOI (S) A regarding the Ferrytoll Junction, which I believe falls under Transport Scotland's remit as a trunk road junction.
Hope Street, carrying the B981, approaches the junction from the north-east and splits into 3 lanes. Lane 1 as a filtered left turn, lane 2 as Left/Ahead, and lane 3 as ahead only.
As recently as 2018, lanes 2 and 3 were instead marked as Left Only and Ahead Only (shown by historic satellite data), meaning that the layout was changed at some point between 2018-2025. All other aspects (hatches, lane boundary markings) appear to have remained the same.
I would like to request information pertaining to this change as follows:
- The number of accidents recorded as taking place on Ferrytoll Junction within the the last 10 years (2015-2025) and, if possible, information regarding whether the entrance mentioned was involved.
- Any discussions, communications, reports or similar mediums pertaining to the repainting of Lanes 2 and 3 of the B981's entrance to the junction as mentioned.
Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
Please see Annex A to this response for a copy of personal injury at the location and date range requested. These records relate to collisions where someone is injured or killed, and which become known to Police Scotland. Therefore, we do not hold records relating to damage-only collisions.
Please note that any figures for 2024 and 2025 are provisional as they are based on monthly returns received thus far from Police Scotland, with the most recent returns being received on 10th March 2025. This may be an incomplete picture of casualties up to that date due to a slight lag between collisions occurring and records being processed and shared by Police Scotland. These figures are also subject to change due to subsequent corrections and late records.
The tables below provide figures for injury collisions recorded as taking place at Ferrytoll junction. Forthe purpose of this req uest the Ferrytoll junction has been defined as the area bounded by the eastings 312236 and 312524 and northings 681747 and 681948. We have provided figures for the Hope street/Ferrytoll junction, which has been defined as the area bounded by the eastings 312365 and 312524 and northings 681747 and 681928.

Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have. We do not have some of the information you have requested as we do not hold any information showing changes to Lanes 2 and 3's markings at the Hope Street/ B981 junction between the period 2018-2025.
This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information about Hope Street/ B981 junction, clearly we cannot provide information which we do not hold.
