Scottish Government spend on legal fees and court cases: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002

Information requested

The total amount spent on legal fees and court cases over the last five years (2019-20 to 2023-24), and ten years (2014-15-2023-24), broken down by year, as well as a description of the costs (i.e. court case – independence referendum at Supreme Court).

Response

I enclose a copy of most of the information you requested in the format you have asked for.

Corporately, we only require to hold the last 7 years worth off financial information. On that basis we have provided you with the last 5 years worth of court cases that have exceeded the value of fifty thousand pounds.

I enclose a copy of most of the information you requested. An exemption(s) under section(s) section 38(1)(b) (personal information) of FOISA applies to that information. We are unable to disclose all of the litigation court case names as this is a clear GDPR issue. In addition, there are GDPR issues on cases which are not subject to a court judgement. On that basis, we have produced and provided you with a redacted list of the litigation court case names within the time frame you have requested.
