Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
All communications from December 1st 2024 onwards between the UK Government and Scottish Government (both ways) on the issue of data sharing in relation to the SG policy of scrapping the two child benefit cap.

While our aim is to provide information whenever possible, in this instance we are unable to provide information you have requested because exemptions under sections s.28(1) Relations within the UK, s.29(1)(a) (policy formulation), s.38(1)(b) (personal information) of FOISA apply to that information.
Section 38(1)(b) exemptions cover personal information of individuals that is not held in the public domain. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
Section 28(1) in this case covers communications between the UK and the Scottish Government that is not yet in the public sphere; or relates to discussions of matters that fall under Section 29(1)(a) where Scottish Government policy is still being formulated. These exemptions are subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is some public interest in release because of interest in open and transparent government.
However, this is outweighed by the public interest in officials being free to discuss matters that are all related to early policy development where the space to have private discussions is essential.
