Equality and Human Rights Commission documentation regarding NHS Scotland's policies on staff single-sex facilities: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

All documents including emails, letters and minutes of meetings regarding discussions with the Equality and Human Rights Commission regarding NHS Scotland's policies and practices relating to access to single-sex changing facilities for staff.

Specifically, please provide said information for the current calendar year.

Response

To complete this request we completed a trawl of all files for any engagement – “including emails, letters, and minutes of meetings” that Scottish Government officials and Ministers have had with the Equality and Human Rights Commission.

The engagement had to be specifically about or reference “single-sex changing facilities for staff” in NHS Scotland.

We searched for documents that fell within the “current calendar year” which covers the period between Wednesday, 1 January 2025 to Monday, 24 February 2025 when your request was received.

The only communication Scottish Government has had with the Equality and Human Rights Commission (EHRC) within those parameters is the initial letter sent to the Cabinet Secretary on 21 February. This letter was published on the EHRC website and is publicly available.

Open letter to the Cabinet Secretary for Health and Social Care – 21 February 2025
