Minister for Social Care, Mental Wellbeing and Sport's care home visit: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

All the documentation held from Ms Todd’s visit to Parklands care home, including email correspondence, internal correspondence, briefings, minutes/notes from the events and analysis.

Response

I enclose a copy of some of the information you requested in the format you asked for.

An exemption(s) under section(s) s.25(1), s.38(1)(b), s.30(b)(i), S.29(1)(a), and s.33(1)(b) of FOISA applies to some of the information you have requested.

S.25(1) applies to a small amount if the information contained in the documents as some of the information is accessible elsewhere.

s.38(1)(b) applies as some of the information contained in the documents related to personal data relating to a third party i.e. names and contact details of individuals. If personal data is shared, it is because it is available in the public domain.

s.30(b)(i) applies as some of the information contained in the documents related to free and frank provision of advice. This exemption applies because disclosure would, or would be likely to, inhibit substantially the free and frank provision of advice.

s.29(1)(a) applies as a small amount of the information contained in the documents related to the formulation or development of Scottish Government policy. The reason for this exemption is because a policy decision has not yet been made and release of this information could hinder this.

s.33(1)(b) applies as a small amount of the information contained in the documents related to commercial interests. The reason for this exemption is because it could influence commercial decisions.
