Annual leave and sick pay calculations for NHS staff: FOI release

Information requested

Regarding NHS Scotland staff, as both Annual Leave and Sickness Absence are calculated using paid as if in work does the following statement from NHS Policy "...regularly paid non-contractual overtime and excess hours should be included in these calculations' apply to both Annual Leave and Sick Pay calculations?

Response

The reference to "...regularly paid non-contractual overtime and excess hours should be included in these calculations' from PCS(AFC)2019/6 is specifically in relation to the calculation of pay during Annual Leave as set out in paragraph 13.9 of the Agenda for Change Handbook.

Sick pay for Agenda for Change staff in NHS Scotland is calculated with reference to paragraph 14.4 of the Agenda for Change Handbook which says:

1. The definition of full pay will include regularly paid supplements, including any recruitment and retention premia, payments for work outside normal hours and high cost area supplements. Sick pay is calculated on the basis of what the individual would have received had he/she been at work. This would be based on the previous three months at work or any other reference period that may be locally agreed. Local partnerships can use virtual rotas showing what hours the employee would have worked in a reference period had he or she been at work.

The specific methodology of how full pay is calculated within these parameters is agreed locally in partnership.
