A9 Dualling Spending Category Breakdown: EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004


Information requested

Please provide the following information:

1. As detailed in the response to FOI 202300379421, £62,087,661.56 has been spent on ‘Ground Investigations and Surveys’, £246,724,112.65 on ‘Preparation Costs (inc design consultants)’, £9,286,250.88 on ‘Land Purchase and Compensation’, and £132,929,371.47 on ‘Construction Costs (inc. advanced works) since 2012 on work towards dualling the A9, if my sums are correct. Please provide a sub-breakdown of the spending on these categories. This should include (but not necessarily be limited to) a brief description of what the spending was on/for (I would expect this to be unique for each item, unless identical work was repeated in the same place in respect of the same thing), the names of any contractors, and the date the expense was incurred.

2. A list of design contractors who have been engaged on the A9 dualling project, with:
a. Total amount paid to each to present date.
b. List of individual payments with date and purpose.
c. The names of any known sub-contracting companies hired by a direct contractor with the Scottish Government, with total amount paid to each to present date, and a list of individual payments with date and purpose.

Please provide the response in excel or csv format.

Responses to each parts of your question are provided below.

As detailed in the response to FOI 202300379421, £62,087,661.56 has been spent on ‘Ground Investigations and Surveys’, £246,724,112.65 on ‘Preparation Costs (inc design consultants)’, £9,286,250.88 on ‘Land Purchase and Compensation’, and £132,929,371.47 on ‘Construction Costs (inc. advanced works) since 2012 on work towards dualling the A9, if my sums are correct. Please provide a sub-breakdown of the spending on these categories. Please refer to attached table detailing breakdown of spend on the A9 Dualling Programme provided as part of your previous request, case 202300379421 with suppliers and date of payments included. The figures provided are inclusive of VAT where applicable.

Some information within the table has been redacted. An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.

Design contractors involved with A9 Dualling Programme include;

  • A9 Dualling: Luncarty to Pass of Birnam - Jacobs UK Limited, formerly known as Jacobs Engineering and also formerly known as Jacobs Consultancy UK Limited.
  • Southern Section (comprises of following sections; Pass of Birnam to Tay Crossing, Tay Crossing to Ballinluig, Pitlochry to Killiecrankie and Killiecrankie to Glen Garry) – Jacobs UK Limited, formerly known as Jacobs Engineering and also formerly known as Jacobs Consultancy UK Limited.
  • Central Section (comprises of following sections; Glen Garry to Dalwhinnie, Dalwhinnie to Crubenmore, Crubenmore to Kincraig) – Jacobs Fairhurst Joint Venture formerly known as CH2M Hill Fairhurst Joint Venture and also formerly known as Halcrow Fairhurst Joint Venture.
  • A9 Dualling: Kincraig to Dalraddy – Atkins Limited
  • Northern Section (comprises Dalraddy to Slochd and Tomatin to Moy) – Atkins Mouchel Joint Venture.

In regards to individual payments made to design contractors, please refer to table attached which can be filtered by scheme, activity and supplier.

c. The names of any known sub-contracting companies hired by a direct contractor with the Scottish Government, with total amount paid to each to present date, and a list of individual payments with date and purpose.

In regards to sub-contracting company details and payments on the A9 Dualling Programme, exception at regulation 10(4)(a) of the EIRs (information not held) applies.

While our aim is to provide information whenever possible, in this instance Transport Scotland does not have the information you have requested under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have. This exemption is subject to the ‘public interest test’.

Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. While we recognise there may be some public interest in sub-contracting company details and payments, clearly we cannot provide information which we do not hold.

The appointment of subcontractors for all of Transport Scotland major projects is the responsibility of the appointed project contractor.
