Response

I attach some of the information you requested.

An exemption under s.38(1)(b)(personal information) of FOISA applies to some of the information you have requested. This exemption applies to personal information including, names, job titles, and contact details.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under section 29(1)(a)(policy formation), section 30(b)(i)(the free and frank provision of advice), and/or section 30(b)(ii)(the free and frank exchange of views for the purpose of deliberation) apply. These exemptions exist to allow future policy to be considered privately and advice given to Ministers and other officials before the Scottish Government reaches a settled public view.

These exemptions are subject to a ‘public interest test’. We have found that the need for Ministers, officials and stakeholders to be able to exchange free and frank views to ensure policy development is fully informed outweighs the public interest in disclosing the information.
