Information requested
The number and percentage of SG employees, including all SG Agencies, who have a criminal conviction.
In particular, you asked for the number and percentage of staff who have a conviction for fraud, assault or theft.
Response
In your request, you have asked for information about Scottish Government staff. Our response therefore covers permanent staff employed in Scottish Government Core Directorates - see Annex A.
You have asked for information about Scottish Government employees with criminal convictions and the number and percentage of staff who have a conviction for fraud, assault or theft. While our aim is to provide information wherever possible, I am unable to provide the information you have requested because the Scottish Government does not hold that information. This is therefore a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
While the Scottish Government does not hold the information you have requested, a minimum level of security clearance is needed for any person requiring access to our sites and information. The minimum level of clearance required for all Scottish Government employees is Baseline Personnel Security Standards (BPSS) which includes a criminal record check (CRC).
Due to GDPR guidelines, relevant information can only be kept at the time of processing and then destroyed.
The Civil Service Code, as set out in the terms and conditions of appointment, and the Scottish Government's employment policies including standards of behaviour and propriety, makes clear that staff are expected to notify the employer where they are charged with or convicted of a criminal offence. Where appropriate, action can then be considered in line with the Scottish Government’s disciplinary policy, including in relation to suspension and/or dismissal.
