Transport Scotland existing contract register: FOI release

Information requested

“I would like to submit a request for some information from the organisation, in relation to their contract’s register.

The FULL contract register should display all the organisations existing/live contracts I would like the register to display the following columns/headings:
1. Contract Reference -Unique reference number associated with the contract.
2. Contract Title.
3. Procurement Category –Please state the category name of the contract, I wish to know the category the contract is under.
4. Supplier Name.
5. Spend (Total, Annual or contract value).
6. Contract’s Duration.
7. Contract’s Extensions.
8. Contract’s Start Date.
9. Contract’s Expiry Date.
10. Contract Description [Please provide me with as much detail as possible].
11. Contact Owner (Person that manages the contract register).
12. CPV codes/Pro-Class.

Contract Data/API Contact Details
1. Can you also provide me with contact details of the person responsible for the actual contract’s register or someone responsible for API? [Name, Job Title, Telephone, Email Address] At the very least provide me with their actual job title. (Meaning of API “a set of functions and procedures that allow the creation of applications which access the features or data of an operating system, application, or other service.”)

IMPORTANT
1. If the organisation has a CRM system or a similar system, there should be a facility to download and extract contract data.
2. You may forward me a Weblink to a portal to download the contract register, please make sure all the organisation’s contracts are provided as doing prior research I have found that most organisations have only uploaded a small portion of all their contracts.
3. For those organisations planning to make an exemption around spend, the spend information I have requested is an overall figure and I am not requesting a complete breakdown of services relating to the spend.

Please provide me with the contract’s register file in an excel format.”

Response

I attach a copy of some of the information you requested in the excel format you asked for.

I can confirm that Public Contracts Scotland hosts a Register of contracts that includes details of contracts valued at £50,000 and above awarded by Transport Scotland.

However, as your request covers all existing/live contracts, I have attached an excel file that includes information for live contracts and frameworks regardless of value which were added to our contract register after 10 May 2022 to the date of your request. The table includes the information requested at:
1. Contract Reference.
2. Contract Title.
3. Procurement Category.
4. Supplier Name.
5. Spend (Total, Annual or contract value)(Contract Value provided).
6. Contract Duration.
7. Contract Extensions (included in Expiry Date).
8. Contract Starting Date.
9. Contract Expiry Date (which includes any authorised extensions).
10. Contract Description(where included in the contracts register).

Exemptions apply for some of the information you requested at:
1. Contract Reference.
2. Contract Title.
3. Procurement Category.
4. Supplier Name.
5. Spend (Total, Annual or contract value)(Contract Value provided).
6. Contract Duration.
7. Contract Extensions (included in Expiry Date).
8. Contract Starting Date.

Most of the information you have requested, under headings 1-10 and the contract data/API contact details, was made available to you following your previous FOI request (reference 20220029942) dated 10 May 2022 and responded to on 06 June 2022. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. Should you need another copy of our response dated 06 June 2022 please let me know.

Some of the information you have requested regarding CPV codes(12) is available at https://www.publiccontractsscotland.gov.uk, for contracts which have had contract notices and/or contract award notices published. As above, under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy.

In addition some of the information that you have requested is not held by Transport Scotland. CPV codes are not recorded for contracts which do not have contract notices or contract award notices published on PCS. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have this part of the information you have requested.

An exemption under section s.38(1) (b) of FOISA also applies to some of the information you have requested for full contact details of contract owners (11) because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
