Flooding on the westbound side of the A84 trunk road in Doune: EIR release

"Regarding the persistent problem of flooding on the westbound side of the A84 trunk road in Doune next to the pavement railings (approx. 56.190635 N, -4.057244 W), I would like to ask the following questions under a freedom of information request.

1. Can you tell me the date this flooding was first reported to you, either by email, telephone, web form or via a 3rd party (like fix my street website or Bear Scotland).

2. Can you tell me how many times in total this flooding has been reported to you since it was first reported".

On 15 July you clarified that, you were interested in reports "since 1st January 2017 as I believe the flooding has been happening since at least then and it has been getting reported since then."

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

To aid with my response I have retained the numbering from your request above.

1. Flooding at this location was first reported on 11 December 2017.
2. Other than the report above, flooding has been reported at this location an additional 15 times.
