Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
I gather that your request may have been submitted following your review of the Charge Code document1007 1517 002 which is available from the following link:
Charge - Find and update company information - GOV.UK (company-information.service.gov.uk)
You asked for:
- A confirmation that interest payments have been made against said loan and continue to be paid to the current date.
- If payments ceased kindly advise date at which said payments ceased and accrued interest to date unpaid.
- In respect of non-payment (if any) kindly advise if Scottish Enterprise shall invoke Clause 7.1 Default of said security.
- Furthermore if payments have not been made and default not enforced then provide copies of any and all communication with and from Liberty Steel Dalzell (or their associate companies) where reference is made to the security document. For avoidance of doubt communication should include all letters, emails, meeting notes and recorded discussions with Liberty Steel Dalzell and its officers.
- Please provide a total sum due against said loan as of today 14th March ’22.
- Kindly confirm when loan is due for repayment in full.
Response
I will respond to each of your points individually.
Point 1- The loan in question has been provided by Scottish Enterprise, rather than Scottish Government. The status of interest payments on an ongoing commercial loan is commercially sensitive and disclosure would be a matter for the borrower and the loan provider to consider.
Point 2- As previously advised, information regarding the status of interest payments and accrued interest unpaid on an ongoing commercial loan is commercially sensitive and disclosure would be a matter for the borrower and the loan provider to consider.
Point 3- The loan in question has been provided by Scottish Enterprise, rather than Scottish Government. The management of an ongoing commercial loan is commercially sensitive, and disclosure of any details would be a matter for the lender to consider.
Point 4- With reference to the security document, the Scottish Government does not hold any letters, emails, meeting notes, recorded discussions or any other communications with Liberty Steel Dalzell or associated companies where the security document has been mentioned.
Point 5- The loan in question has been provided by Scottish Enterprise and Scottish Government does not hold this information.
Point 6- The loan in question has been provided by Scottish Enterprise, rather than Scottish Government. The details and management of an ongoing commercial loan are commercially sensitive, and disclosure of any details would be a matter for the lender.
